I. INTRODUCTION TO THE DEPARTMENT OF CIVIL AND CRIMINAL LAW

The Department of Civil and Criminal Law is one of three departments under the Faculty of Law, Can Tho University, established in February 2000 with the establishment of the Faculty. Over two decades of dedicated growth, the Department has significantly enhanced the qualifications of its teaching staff and the quality of its educational programs and research initiatives.
The Department of Civil and Criminal Law is accountable for the curriculum, quality assurance, and pedagogical progress of the courses it oversees within the Faculty’s academic programs. Specifically, the Department’s responsibilities include course development, textbook compilation, reference material creation, and pedagogical research and innovation. Moreover, the Department directly assigns and supervises faculty members in teaching and student assessment.
For additional responsibilities, the Department conducts research initiatives, develops faculty development plans, and organizes annual evaluations of departmental management, training programs, and individual and departmental research and innovation activities, aligning with the Faculty’s and University’s guidelines.

III. TRAINING FUNCTION
The Department of Civil and Criminal Law offers undergraduate degree programs in Judicial Law, Administrative Law, and Economic Law, encompassing both full-time and part-time modalities. Our responsibilities extend to curriculum development, detailed course outlines, faculty assignment, and the creation of textbooks and teaching materials.
The Bachelor of Laws program with a specialization in Judicial Law equips students with a comprehensive understanding of the legal field and the adaptability to navigate its dynamic landscape. Our curriculum seamlessly integrates theoretical foundations, legal regulations, and practical applications, complemented by a broader understanding of cultural, societal, and political contexts. Concurrently, students develop essential legal practice, leadership, and entrepreneurial skills through hands-on experiences. Beyond technical proficiency, our graduates are distinguished by their independent thought processes, self-directed learning, and ability to stay abreast of evolving legal frameworks and policies.
The curriculum for law students specializing in Judicial Law primarily centers on two core areas: civil and civil procedure law, and criminal and criminal Procedure law. In addition to this specialized knowledge, students are also equipped with a solid foundation in general legal principles, industry-relevant insights, and foundational understanding of other legal domains, including Administrative Law, Constitutional Law, Economic Law, and International Law.
1. Criminal Law: Theoretical Foundations of Crime
This course delves into the fundamental principles governing criminal law within the Vietnamese legal framework, examining its role in regulating criminal behavior and punishments. Key areas of study include the general concepts and subjects of Criminal Law, providing students with a comprehensive understanding of crimes and penalties.
2. Criminal Law: Theoretical Issues on Punishment
This course delves into the complexities of criminal punishment, examining intricate cases involving multiple perpetrators and instances of legal justification. A central focus is on the concept of punishment as a severe state-imposed sanction applicable exclusively to convicted criminals. Additionally, the course explores sentencing guidelines, exemptions from criminal liability, reductions in punishment, pardons, and specific regulations governing juvenile offenders.
3. Criminal Law: Defining Crimes and Determining Punishments
This course explores the crucial aspects of crime classification and identification within the legal system. Students will gain a deep understanding of these concepts, including their legal implications and potential consequences. By mastering these topics, students will develop a strong foundation for understanding the legal framework surrounding criminal investigations, prosecutions, and subsequent proceedings.
4. International Criminal Law
This course provides students with a comprehensive understanding of the principles, regulations, and procedures governing international criminal law. Through in-depth exploration of relevant treaties, conventions, and case law, students will develop a strong foundation in this complex area of law.
5. Criminology
This course offers a comprehensive exploration of criminology, encompassing crime patterns, causal factors, offender profiles, and effective crime prevention strategies. Through in-depth study, students will develop the analytical skills necessary to assess crime situations, identify specific crime types, and implement targeted prevention initiatives. This knowledge will equip graduates with the expertise to effectively address and mitigate criminal activities in their future careers.
6. Civil Law: Property, Ownership and Inheritance
This course provides a comprehensive overview of Vietnamese Civil Law, encompassing the rights, obligations, and legal relationships pertaining to individuals and entities. Students will delve into the intricacies of property rights, ownership principles, and contemporary legal issues surrounding inheritance. Upon completion, students will possess a solid foundation in these critical areas of civil law.
7. Civil Law: Civil Obligations and Contracts
This course provides a comprehensive exploration of the legal principles governing civil obligations and contractual relationships. Through in-depth study, students will develop a robust understanding of the mechanisms for establishing and managing contractual agreements, as well as navigating various life events with legal clarity. This foundational knowledge will serve as a valuable asset for further studies in related fields, such as civil liability, contractual guarantees, and common contracts.
8. Marriage and Family Law
This course offers a comprehensive exploration of legal principles governing marriage and family relationships. Students will delve into foundational aspects such as marital eligibility, family dynamics, divorce proceedings, and spousal support. Through in-depth study, students will develop a robust understanding of the legal framework surrounding these critical areas, enabling them to navigate complex family matters with confidence and expertise.
9. General Theoretical Issues in Criminal Procedure Law
This course provides a comprehensive overview of fundamental concepts and principles within Vietnamese criminal procedure law. Students will gain a clear understanding of the distinctions between criminal law and criminal procedure law, explore the scope, objectives, and key principles of criminal procedure, and delve into the organizational structure, powers, and responsibilities of procedural agencies and participants. Additionally, the course will cover the theories and practices of evidence, as well as preventive and coercive measures outlined in the Criminal Procedure Code.
10. Procedures for Resolving Criminal Cases
This course provides a comprehensive overview of the procedural framework governing criminal investigations, prosecutions, trials, and sentencing in Vietnam. By delving into the intricacies of each stage, students will gain a deep understanding of the legal principles and practices that underpin the criminal justice system. This knowledge will equip graduates with the expertise to effectively navigate and contribute to the resolution of criminal cases, ensuring the fair and efficient administration of justice.
11. General Theoretical Issues on Civil Procedure Law
The Civil Procedure Law course will help students consolidate their knowledge in specialized subjects and effectively apply it to professions such as: Lawyer; Court; Procuratorate; Enforcement of judgments; and participation in civil lawsuits.
12. Civil Case Resolution Procedures
This course offers a comprehensive exploration of the procedural framework governing civil lawsuits in Vietnam, encompassing stages such as case initiation, acceptance, trial, and judgment enforcement. Through in-depth study and practical exercises, students will gain a thorough understanding of the legal principles and practices that underpin these processes. The course instructor facilitates simulated court proceedings to enhance students’ ability to apply their knowledge and develop essential skills for effective legal representation.
13. Obligation Guarantees
This course offers a comprehensive exploration of the legal framework governing obligation guarantees in Vietnam. Students will delve into a range of security measures, including guarantees, pledges, mortgages, security by ownership rights, security by privileges, and deposits. Additionally, the course will provide in-depth analysis of the procedures for registering secured transactions and managing secured assets.
14. Intellectual Property Law
This course offers a comprehensive exploration of the legal framework governing intellectual property, emphasizing its pivotal role in fostering individual, organizational, and national progress. Through in-depth analysis of intellectual property subjects, rights, and registration procedures, students will develop a robust understanding of this critical area of law. This knowledge will equip graduates with the expertise to safeguard their own intellectual property while upholding the rights of others.
15. Additional Courses
To complement their specialized studies, Judicial Law students will also be exposed to a comprehensive curriculum of foundational and elective courses. These include General Theory of State and Law, Constitutional Law, Administrative Law, Commercial Law, Legal Terminology (English or French), Roman Civil Law, State Finance Law, Labor Law, Environmental Law, Land Law, International Public Law, International Private Law, International Commercial Law, Criminal Investigation Science, and Forensic Examination.
