DEPARTMENT OF CRIMINAL AND CIVIL LAW

The Department of Criminal and Civil Law is one of the three Departments under the School of Law - Can Tho University. Established in December 2000.
The Head of Department (Dr. Nguyen Phan Khoi) is in charge of the Department of Criminal and Civil Law.
I. MISSION
The Department provides the program of Bachelors of Law professional in criminal and civil law, meet the requirement of employers in concerned sectors.
II. REQUIREMENTS OF A STUDENT OF JUSTICE LAW
At the beginning of every course, under the guidance and assistance of the School, students will sign up to the Program.

Students majoring in Criminal and Civil Law are expected to acquire the knowledge of civil law, criminal law, guarantee obligations, common contract law, criminology, and notarized. Basic knowledge in investigation, inspection, and court hearing such as criminal investigation, forensic examination, and court activities is included. In addition, profound issues on civil procedure, criminal procedure, marriage and family, intellectual property and inheritance are supplied as part of the Program.

III. CAREER OPPORTUNITIES
Law Bachelors majoring in Criminal and Civil Law would find themselves appropriate in the judicial system such as Courts and Procuracies, investigation and enforcement agencies, and Attorney associations. Graduates are expected to meet the requirement of other organizations such as the People's Committees and its departments and divisions, press and media, enterprises, etc…

IV. THE MAIN COURSES
Main courses of law students majoring in Criminal and Civil Law.
1. Criminal Law 1 (2 credits)
The course clarifies Criminal Law as an independent legal profession in Vietnam legal system regarding to crimes and penalties.
Main contents: general concepts and subjects of the Criminal Code, knowledge of crimes and penalties.
2. Criminal Law 2 (2 credits)
The course provides knowledge of complex criminal cases such as multi-subject cases or cases in which excluded criminal nature involved. Moreover, this course provides students with the knowledge of the penalty - one of the strict enforcement measures applied to offenders. In addition, knowledge of penalty decision-making, circumstances aggravating and extenuating the criminal liabilities of the accused or defendants, and penalty exemptions are expected to be delivered. Finally, the course offers specific provisions of juvenile offenders.
3. Criminal Law 3 (2 credits)
The course provides theoretical knowledge of the crimes determination and its significance.
4. Intensive Criminal Law (2 credits)
The course provides in-depth knowledge of the institutions of the Criminal Law as well as the theoretical and practical issues of crime determination and penalty range.
5. Criminology (2 credits)
Crime characteristics, the causes of crime, identification of personal characteristics of offenders, crime precautions methodology in general, and that of particular crimes are expected to be acquired. Graduated students may apply this knowledge to crime analysis and evaluation, as well as to prevent and deter crime and criminals.
6. Civil Law 1 (3 credits)
Basic knowledge of Viet Nam Civil Law in general, the rights and obligations of the subject, the subjects of civil law relations, issues relating to property, and property ownership rights are the content of the course.
7. Civil Law 2 (3 credits)
Basic knowledge regarding to the establishment of obligations in civil transactions and legal events is offered. This knowledge will be essential to acquire later modules such as: Civil Liability Law, Measures to secure the performance of civil obligation, and Common Contracts, etc.
8. Marriage and Family Law (2 credits)
Basic issues of Marriage and Family such as condition of marriage, family relationships, divorce and alimony issues are the content of the course.
9. Law of Criminal Procedure 1 (2 credits)
The course offers systematic general knowledge regarding to general issues of Viet Nam criminal procedure, differentiate and define the relationship between criminal law and Law of criminal procedure: its concepts, mission, and basic principles; organizational structure, responsibilities and jurisdiction of the agencies conducting proceedings and their relationship, jurisdiction and responsibilities of the personnel conducting the proceedings, the rights and obligations of the parties participating in the proceedings; theory and practice of evidence as well as the preventive measures prescribed in the Criminal Procedure Code.
10. Law of Criminal Procedure 2 (2 credits)
The course offers knowledge of prosecution order and procedures, investigation, prosecution, adjudication and enforcement of criminal cases in accordance with the current Viet Nam legislation; as well as the meaning and significance of every stage of the proceedings - which is crime prevention, rapid detection and promptly enforcement of every offense, and prevention of any misjudgment.

11. Law of Civil Procedure 1 (2 credits)

The course consolidates the knowledge of specialized subjects and it is applicable in professions fields such as Attorney, Court, Procuracy, Enforcement of judgments and participation in civil cases.

12. Law of Civil Procedure 2 (2 credits)

The course offers better understanding of the regulations and the order of execution in each stage, beginning from the petitioner, the acceptance, the hearings, and ended with the enforcement of civil judgments. Participants of the course may apply these knowledge to the court procedures.

13. Comparative Law (2 credits)

The course offers basic knowledge of comparative law and the unique features of advanced jurisprudence in the world through a brief understanding of the legal systems in some countries: England, France , United States, Germany, Japan, China, and specific solutions of those legal system in the statutory of possession, contracts, strict civil liability, trust, fiduciary relation, etc.

14. Measures to secure the performance of civil obligation (2 credits)
The course offers basic knowledge regarding to the implementation to ensure the implementation under Viet Nam legislation in general and specific security measures such as guarantees, pledge, mortgage, guaranteed by property rights, guaranteed by privilege, collateral, as well as the knowledge regarding to secured transactions registration and handling of secured assets.
15. Intellectual property Law (2 credits)
The course clarifies the significance of intellectual assets to organizations, individuals, and the development of every country. The course provides common understanding of the subject of intellectual property, the rights of entities, registration processes and procedures of intellectual property rights. In addition, it offers an initial awareness of the learners’ intellectual property and to respect the intellectual property of others.
16. Other courses
In addition to the abovementioned main courses, students majoring in Justice Law are expected to take other course regarding to general knowledge and specialized courses as students majoring in other professions of Law. The courses are: General Theory of State and legislation, English (or French), Constitutional Law, Administrative Law, Commercial Law, Roman Civil law, State Finance Law, Labor Law, Environmental Law, Land law, Public International Law, Private International Law, International Commercial Law, Criminal Investigations Science, Forensic Science, Organization and Operation of Notary, Sources of law. . ./
