DEPARTMENT OF ADMINISTRATIVE LAW

Department of Administrative Law (DAL) was established in February 2000 and is part of School of Law of Can Tho University.

Dr. Chau Hoang Than is in charge of the head of the Department and Dr. Huynh Thi Sinh Hien is the deputy head.

I. FUNCTION

The DAL’s main mission is to train undergraduates in law to gain professional knowledge of state management and capacity to quickly adapt to social changes.

II. CAREER OPPORTUNITIES

The students who graduate from administrative law have several opportunities to work for different local government offices. They can work for offices of people’s committees and departments of local governments.  In addition, they are qualified to work for administrative law courts, offices of prosecutors, television stations, news agencies, law firms, and companies.

III. MAJOR COURSES OF CIRRICULUM

The curriculum of Administrative law undergraduate program consists of the following major courses.

1. Administrative Law 1 (2 credits)

Administrative Law is a branch of law dealing with public administration/state management and relationships occurring in state management. The main content of the course is to introduce and analyse the concept of administrative law and state management, the subjects to and governing method of administrative law, the principles of state management, state bureaucracy system and the subjects to state management.

2. Administrative Law 2 (2 credits)

The main content of the course is to study methods of state management and ways to improve efficiency of state management. It offers students knowledge of content, forms and methods of state management, definition, characteristics and categories of administrative decisions, knowledge of administrative violations and administrative liability, and administrative procedures. In addition, students have chance to study ways to ensure efficiency and effectiveness of state administration such as prevention from and combat with corruptions and administration reform.

3. Administrative Law 3 (2 credits)

In this course students have chance to gain a deep theoretical knowledge of state management such as relations between administrative agencies and the other state organs and those between administrative agencies and citizens and organizations. Additionally, the course gives students a great opportunity to study in depth state management in specific areas such as state management in religion and belief practices, in ethnic minority issues, and in organization and operation of offices of people’s committees.

4. Law on complaints and judicial review of administrative decisions (2 credits)

This course gives students a general knowledge of challenging an administrative decisions/actions by using administrative complaints or judicial review of administrative decisions. Students also study judicial reviews of administrative law courts – a court of law as part of people’s courts. The course offers knowledge of dealing with administrative complaints, the way that administrative agencies reviewing their administrative decisions/actions, the way that administrative law courts reviewing administrative decisions/actions and the legal rights and responsibilities of parties in resettlement of administrative complaints and in judicial review of administrative decisions.

5. Urban planning (2 credits)

This course gives students a chance to study systematically important legal issues related to urban planning and land expropriation in Viet Nam. It offers legal knowledge of the process of establishing, reviewing, approving and executing construction planning; the process of land expropriation, compensation and resettlement. After gaining such legal knowledge, students are able to practice the relevant law to deal with matters related happening in reality and in their works in state management after graduation.

6. Foreign Administrative Law and Constitutional Law (2 credits)

The course offers a comparative study in administrative agency systems of other countries such as France, the Netherlands, Canada, and the United States of America. It aims to provide students knowledge of organization and activities of foreign administrative agency systems so that they can compare these systems with our Vietnamese one and suggest improvements to our system.

7. Advanced Constitutional Law (2 credits)

This course provides students deep knowledge of issues related to constitutional law by analysing, assessing and giving opinions on these issues. This course mainly aims to train students’ research skills such as searching for references, analysing and assessing the references, writing research papers, presenting and discussing. Thanks to these skills, students are able to study advanced knowledge of constitutional law such as subjects governed by constitutional law to define the constitutional law as an independent body of law; the relation between rights of citizens and human rights; policy on reform of local governments; suggestions to improve efficiency of criticism and vote of confidence; analysis of imperfections in the principles of organization and operation of people’s courts. 

8. Office Administration and Human resource management (2 credits)

This course aims to give students knowledge and skills of organizing and managing offices, which is important to ensure efficiency of government offices. In addition, students study general knowledge of human resource management in government offices in general and in administrative agencies in particular.

9. Other courses

Besides the major courses mentioned above, like other law students, administrative law students study general courses in law. These general courses consist of general theory of law and state, English or French, Constitutional Law, Criminal Law, Civil Law, Labour Law, Marriage and Family Law, Environmental Law, Land Law, Commercial Law, Criminal Procedural Law, Civil Procedural Law, International Private Law, International Public Law, International Commercial Law, etc.
